{"id":29874,"date":"2016-02-16T19:27:02","date_gmt":"2016-02-17T01:27:02","guid":{"rendered":"http:\/\/news.medill.northwestern.edu\/chicago\/?p=29874"},"modified":"2016-02-17T13:35:00","modified_gmt":"2016-02-17T19:35:00","slug":"coalition-calls-for-special-prosecutor-in-jason-van-dyke-murder-case","status":"publish","type":"post","link":"https:\/\/news.medill.northwestern.edu\/chicago\/coalition-calls-for-special-prosecutor-in-jason-van-dyke-murder-case\/","title":{"rendered":"Coalition calls for special prosecutor in Jason Van Dyke murder case"},"content":{"rendered":"<p><strong>By Aryn Braun and Misha Euceph<\/strong><br \/>\n<strong>Video by Kierra Gray<\/strong><\/p>\n<p class=\"dropcap\">In a petition filed this morning, 27 interested parties called for a special prosecutor in the trial of police officer Jason Van Dyke, citing Cook County State\u2019s Attorney Anita Alvarez\u2019s close ties to the Fraternal Order of Police as a \u201cconflict of interest.\u201d<\/p>\n<p>The petitioners, including U.S. Representatives Danny Davis and Bobby Rush, and Cook County Commissioner and former mayoral candidate Jes\u00fas \u201cChuy\u201d Garcia, point to Alvarez\u2019s continued involvement in the case as unjust and compromising.<\/p>\n<p>Specifically, the group said that Alvarez\u2019s decision to wait to charge Van Dyke, a white officer who shot black teenager Laquan McDonald, for a year casts a questionable light on her ability to fairly prosecute the officer.<\/p>\n<p>\u201cLaquan McDonald was a constituent of mine,\u201d said Davis, who stood at the front of the room alongside Marvin Hunter, McDonald\u2019s great-uncle and pastor at Grace Memorial Baptist Church in North Lawndale.<br \/>\n[vimeo 155681400 w=474]<!--more--><br \/>\n\u201cThis has galvanized the community of Lawndale,\u201d said Hunter. \u201cPeople feel this. This was a kid that died, and it was an execution.\u201d<\/p>\n<p>Illinois\u2019 special prosecutor statute entitles anyone, including the state\u2019s attorney herself, to call for the appointment of a special prosecutor in a case in which the state\u2019s attorney\u2019s office has a conflict of interest, according to Locke Bowman, Executive Director of Northwestern University\u2019s MacArthur Justice Center.<\/p>\n<p>The petition announcement comes one month before the March 15 State&#8217;s Attorney election, in which Alvarez faces challengers Donna More and Kim Foxx, whom the Democratic Party endorsed on Jan. 14.<\/p>\n<p>Although many of the representatives present at the announcement of the petition identify with the Democratic Party and support Kim Foxx, Bowman stressed that \u201cthere is no conflict of interest,\u201d and the announcement wasn&#8217;t political in nature.<\/p>\n<p>\u201cWe thought the state\u2019s attorney might step up,\u201d said Bowman. \u201cWe waited for others to step forward. When it became apparent that nothing was happening, we stepped in.\u201d Bowman explained that the coalition\u2019s decision to announce the petition a few weeks before the election was not an attempt to influence the vote.<\/p>\n<p>Alvarez\u2019s office disagreed. \u201cIf any party with standing wants to make that request and legal arguments that would merit the appointment of a special state\u2019s attorney, they should do so in a court of law, not a press conference,\u201d said Alvarez in a statement released after the announcement.<\/p>\n<p>The coalition said they will present the petition to Leroy Martin, Jr., Presiding Judge of the Criminal Division of the Circuit Court of Cook County on Feb. 26. After the motion, Judge Martin will decide whether to launch an official inquiry into Alvarez\u2019s alleged conflict of interest in prosecuting the Van Dyke case, Bowman said.<\/p>\n<p>If Judge Martin grants a hearing, both Alvarez and the petitioners will have a chance to argue for or against the need for a special prosecutor. With only four weeks before the state\u2019s attorney election, it appears unlikely that the judge will make a ruling before the vote.<\/p>\n<p>\u201cIf Anita Alvarez isn\u2019t the state\u2019s attorney anymore then this personal conflict isn\u2019t an issue,\u201d said Bowman, suggesting that the petition becomes moot if one of Alvarez\u2019s challengers wins the election.<\/p>\n<div class=\"featurecaption\">Photo at top: Former mayoral candidate Jesus &#8220;Chuy&#8221; Garcia (right) is one of 27 petitioners supporting the use of a special prosecutor in the Jason Van Dyke case.
