Bruce Rauner\u2019s Commission on Criminal Justice and Sentencing Reform, but called on the governor to bolster its credibility and efficiency by including formerly incarcerated people among its appointees.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The commission, which Rauner created by <a href=\"http:\/\/www.illinois.gov\/Government\/ExecOrders\/Documents\/2015\/ExecutiveOrder2015-14.pdf\" target=\"_blank\">executive order<\/a> last week, has a mandate to examine ways to reduce the state\u2019s prison population by 25 percent in the next 10 years through a largely holistic approach that considers a range of issues in the criminal justice system.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">To fully understand those issues, experts said, the commission needs to hear from those who know them best.<\/span><\/p>\n<p class=\"p1\"><!--more--><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIf we want to understand how to help people not go back into the system, not be re-arrested, to me there\u2019s nobody that knows better about what that experience is like than those who have been through it themselves,\u201d<\/span> <span class=\"s1\">said Matthew Epperson, a professor who specializes in criminal justice reforms at the University of Chicago\u2019s School of Social Service Administration.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Amos Irwin, policy director at the Washington D.C.-based <a href=\"http:\/\/www.cjpf.org\/\" target=\"_blank\">Criminal Justice Policy Foundation<\/a>, agreed.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThere is a growing number of organizations organized by people who are formerly incarcerated,\u201d<\/span> <span class=\"s1\">Irwin said. \u201cThat\u2019s an incredibly important perspective, people who have been through the system and have turned their lives around. They understand what it takes.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Rauner has yet to formally announce any appointments to the commission, though his mandate calls for input from victims\u2019<\/span> <span class=\"s1\">rights advocates, judges and state lawmakers. <a href=\"http:\/\/www.chicagotribune.com\/news\/local\/politics\/chi-rauner-looking-at-criminal-justice-system-overhaul-20150211-story.html\" target=\"_blank\">The Chicago Tribune reported on Feb. 11<\/a> that Democratic state Sen. Kwame Raoul, who has campaigned on criminal justice reform, had been appointed.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">A spokeswoman for Rauner declined to say this week whether the governor was considering appointing any formerly incarcerated individuals or representatives from organizations they serve.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe administration is aggressively working to find the right experts from a wide variety of fields who will develop recommendations that reduce the prison population while improving public safety,\u201d<\/span> <span class=\"s1\">said spokeswoman Catherine Kelly in an e-mailed statement.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Mike Holman, a leader of the Chicago chapter of the Stop Mass Incarceration Network, a group that protests against overcrowded prisons and Illinois\u2019<\/span> <span class=\"s1\">use of solitary confinement, echoed Epperson and Irwin but said he didn\u2019t think the chances of the Rauner administration agreeing with them were high.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cI don\u2019t think there\u2019s any fundamental disagreement by the Rauner administration, or any governor, with generally the way prisons are run,\u201d<\/span> <span class=\"s1\">he said. \u201cI don\u2019t think they\u2019d listen.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">But while other states have enacted reforms through legislation and voter referenda, Rauner\u2019s commission is the first of its kind anywhere in the country. Irwin praised the governor for being a politician \u201cwilling to stick his neck out\u201d<\/span> <span class=\"s1\">on an issue that often results in soft-on-crime criticism. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Laura Brookes, the director of policy for the Chicago-based organization <a href=\"http:\/\/www2.tasc.org\/\" target=\"_blank\">Treatment Alternatives for Safe Communities<\/a>, said she was \u201cthrilled\u201d<\/span> <span class=\"s1\">with Rauner\u2019s order, mainly due to its focus on treatment-based alternatives to incarceration. But failing to include the voices of those affected by the system, in addition to those who oversee it, would be a mistake, Epperson said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThere\u2019s many people who come out of prison and don\u2019t recidivate and they do productive things and they get support and they struggle through and they get their lives back together,\u201d<\/span> <span class=\"s1\">he said. \u201cSo not having them at the table could be a real missed opportunity and I think in that way, Illinois could be an innovator.\u201d<\/span><\/p>\n<figure id=\"attachment_7071\" aria-describedby=\"caption-attachment-7071\" style=\"width: 960px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/news.medill.northwestern.edu\/chicago\/wp-content\/uploads\/sites\/3\/2015\/02\/KeyStats.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-7071\" src=\"http:\/\/news.medill.northwestern.edu\/chicago\/wp-content\/uploads\/sites\/3\/2015\/02\/KeyStats.jpg\" alt=\"(Dean DeChiaro\/MEDILL)\" width=\"960\" height=\"1000\" srcset=\"https:\/\/news.medill.northwestern.edu\/chicago\/wp-content\/uploads\/sites\/3\/2015\/02\/KeyStats.jpg 960w, https:\/\/news.medill.northwestern.edu\/chicago\/wp-content\/uploads\/sites\/3\/2015\/02\/KeyStats-288x300.jpg 288w\" sizes=\"(max-width: 960px) 100vw, 960px\" \/><\/a><figcaption id=\"caption-attachment-7071\" class=\"wp-caption-text\">(Dean DeChiaro\/MEDILL)<\/figcaption><\/figure>\n<h1>Ideas and priorities<\/h1>\n<p class=\"p1\"><span class=\"s1\">Rauner\u2019s executive order tasks the commission with examining a wide range of issues typically cited as causing upticks in incarceration levels and prison spending, including strict sentencing laws commonly known as mandatory minimums. Rauner also ordered the commission to probe the under-use of opportunities to funnel inmates to treatment facilities or community organizations that function as alternatives to incarceration for nonviolent offenders.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In Illinois, the prison population has has grown over 700 percent in the past 40 years, <a href=\"http:\/\/thejha.org\/sites\/default\/files\/JHA_Report_Changing_Directions1.pdf\" target=\"_blank\">according to a report<\/a> by the John Howard Association, a Chicago non-partisan criminal justice reform group. According to the executive order, the state spends about $1.3 billion and $131 million per year on the Department of Corrections and Department of Juvenile Justice, respectively. Forty-eight percent of adults and 53 percent of juveniles are back in the system within three years.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Reform advocates were supportive of the comprehensive nature of Rauner\u2019s mandate, arguing that the system can\u2019t be reformed by attacking any single issue \u2014<\/span> <span class=\"s1\">from education to job training to drug treatment and mental health care.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cReform like this can\u2019t be achieved in a piecemeal process,\u201d<\/span> <span class=\"s1\">said Kim Chanbonpin, a professor of criminal law at the John Marshall Law School. \u201cI think the only way to effectively reform the criminal justice system is to look at it holistically.\u201d<\/span><\/p>\n<blockquote>\n<p class=\"p1\">\u201cThat\u2019s an incredibly important perspective, people who have been through the system and have turned their lives around. They understand what it takes.\u201d<\/p>\n<p class=\"p1\">&#8211; Amos Irwin, Criminal Justice Policy Foundation<\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">Those who advocate for alternatives to incarceration for nonviolent offenders, like Epperson and Brookes, say there\u2019s evidence that proves placement into treatment facilities reduces the risk of recidivism. According to an internal study by Brookes\u2019<\/span> <span class=\"s1\">organization, there was a 71 percent reduction in arrests for drug and property crimes two years after enrollment in the group\u2019s various programs.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cDiverting those people who are currently legally qualified, we don\u2019t have to change any laws for that,\u201d<\/span> <span class=\"s1\">Brookes said. \u201cIt\u2019s a matter of taking a look at the system across the spectrum of entities, doing an assessment and identifying where and how we could be diverting more of those people.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Irwin said the commission could reach for \u201clow-hanging fruit\u201d<\/span> <span class=\"s1\">by studying ways to reform mandatory minimums, laws that force judges to hand down uniform sentences for certain crimes. Such laws have been criticized as discriminatory against racial minorities and the poor and for being a key contributor to prison overcrowding.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThere are policy changes that you can do that just result in fewer arrests, fewer people being brought back into the system and they don\u2019t force you into hard [financial] decisions,\u201d<\/span> <span class=\"s1\">he said. \u201cThey are a money saver by any measure.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Educational opportunities in prisons is another area where advocates say the commission should focus its attention. Rebecca Ginsburg, who runs the <a href=\"http:\/\/www.educationjustice.net\/home\/\" target=\"_blank\">Education Justice Project at the University of Illinois at Urbana-Champaign<\/a>, said investing in internal prison education programs is key to reducing recidivism rates.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">According to Ginsburg, less than 50 percent of those released from Illinois prisons find employment within eight months of their release. Of those who participated in her group\u2019s program, which offers college courses to inmates at the Danville Correctional Facility, 75 percent found employment within seven weeks.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cWe pay the cost for not investing in education,\u201d<\/span> <span class=\"s1\">she said.<\/span><\/p>\n<div id=\"featurecaption\">Photo at top:\u00a0<span class=\"s1\">An exterior view of the Cook County jail, one of the largest pre-trial detention centers in the country.
