{"id":96173,"date":"2021-05-05T12:49:17","date_gmt":"2021-05-05T17:49:17","guid":{"rendered":"https:\/\/news.medill.northwestern.edu\/chicago\/?p=96173"},"modified":"2021-05-05T12:49:17","modified_gmt":"2021-05-05T17:49:17","slug":"what-you-need-to-know-about-your-neighbors-secondhand-smoke-and-what-you-can-do-about-it","status":"publish","type":"post","link":"https:\/\/news.medill.northwestern.edu\/chicago\/what-you-need-to-know-about-your-neighbors-secondhand-smoke-and-what-you-can-do-about-it\/","title":{"rendered":"What you need to know about your neighbor\u2019s secondhand smoke \u2013 and what you can do about it"},"content":{"rendered":"<p><strong>By Erin Warwood<\/strong><br \/>\n<em>Medill Reports<\/em><\/p>\n<p>When a neighbor\u2019s tobacco smoke keeps coming into your space, you may wonder what you can do to stop it \u2013 and you should.<\/p>\n<p>A 2020 <a href=\"https:\/\/bmcpublichealth.biomedcentral.com\/articles\/10.1186\/s12889-020-09970-1\">study<\/a> of German adults who had never smoked and self-reported at least an hour of secondhand smoke exposure per day were 59% more likely to be depressed than those who reported no exposure. Researchers, who published their results in <a href=\"https:\/\/bmcpublichealth.biomedcentral.com\/\">BMC Public Health<\/a>, noted that there are a few possible underlying mechanisms. For instance, secondhand smoke may reduce levels of mood-regulating neurotransmitters like dopamine and serotonin.<\/p>\n<p>Though more studies are needed to clarify the relationship between secondhand smoke and depression, \u201cthe U.S. surgeon general has <a href=\"https:\/\/www.cdc.gov\/tobacco\/data_statistics\/sgr\/2006\/pdfs\/no-risk-free.pdf\">confirmed<\/a> there is no safe level of exposure,\u201d said Liz Williams, a project and policy manager at the American Nonsmokers\u2019 Rights Foundation.<\/p>\n<p>In fact, secondhand smoke exposure is estimated to cause 41,000 deaths among adults every year, according to the <a href=\"https:\/\/www.cdc.gov\/tobacco\/data_statistics\/fact_sheets\/health_effects\/tobacco_related_mortality\/index.htm#:~:text=Exposure%20to%20secondhand%20smoke%20causes,adults%20in%20the%20United%20States%3A&amp;text=Secondhand%20smoke%20causes%207%2C333%20annual%20deaths%20from%20lung%20cancer.&amp;text=Secondhand%20smoke%20causes%2033%2C951%20annual%20deaths%20from%20heart%20disease.\">Centers for Disease Control<\/a>.<\/p>\n<p>If you\u2019re suddenly anxious about what you\u2019re inhaling, take a deep breath: Experts weigh in on the questions you might have if you\u2019re struggling with secondhand smoke exposure.<\/p>\n<p><strong>Are there rules against smoking in multiunit housing?<\/strong><\/p>\n<p>\u201cHUD [the U.S. Department of Housing and Urban Development] now requires all public housing buildings to be smoke-free,\u201d Williams said. She also noted that <a href=\"https:\/\/no-smoke.org\/wp-content\/uploads\/pdf\/smokefreemuh.pdf\">some communities<\/a> in California have passed citywide or countywide laws requiring multiunit housing complexes to go 100% smoke-free, and some states\u2019 laws prohibit smoking in the common areas of these buildings. If your state or community hasn\u2019t yet followed suit, your building needs to adopt its own policy.<\/p>\n<p><strong>So it\u2019s legal for buildings to ban smoking?<\/strong><\/p>\n<p>Yes. It\u2019s <a href=\"https:\/\/no-smoke.org\/frequently-asked-questions-housing-providers-smokefree-buildings\/\">not discriminatory<\/a>, Williams said. In fact, many buildings throughout the country are smoke-free.<\/p>\n<p><strong>How do I know if my building \u2013 or a building that I might move into \u2013 has a nonsmoking policy?<\/strong><\/p>\n<p>Check your lease or the covenants, conditions and restrictions for the homeowners association. If a policy exists, it should mention smoking, Williams said. Beware of vague rules: \u201cIf it says nuisance, but doesn&#8217;t say \u2018no smoking\u2019 specifically, then you don&#8217;t really want to trust that that would cover the situation if the neighbor&#8217;s smoke is drifting,\u201d she advised.<\/p>\n<p>If your building does have a policy, the American Nonsmokers\u2019 Rights Foundation offers <a href=\"https:\/\/no-smoke.org\/enforcement-tips-building-managers-maintenance-staff\/\">enforcement tips<\/a> for managers. It also tries to support smokers and help them find a way to comply, Williams said.<\/p>\n<p><strong>If these policies don\u2019t exist for my building, should I talk to my neighbor directly?<\/strong><\/p>\n<p>Not so fast. You want to stay away from what could be an aggressive confrontation (and avoid unnecessary interaction during the pandemic). \u201cI do think getting management involved when it\u2019s a situation that you consider offensive is the best route to take,\u201d said Diane Gottsman, national etiquette expert, author of \u201cModern Etiquette for a Better Life\u201d and founder of The Protocol School of Texas.<\/p>\n<p><strong>So I should talk to management?<\/strong><\/p>\n<p>Definitely. Your landlord might not even know there\u2019s a problem, Williams said. \u201cThe first thing that we recommend that people do is to keep a log.\u201d Keep a written record of when and where you\u2019re smelling smoke so you can pick up on patterns. Then, share that information with your landlord in writing, along with how it\u2019s affecting your ability to use the property, Williams suggested. And include your specific ask: Are you hoping the whole building will go smoke-free, or do you want a less restrictive policy, such as no smoking on balconies?<\/p>\n<p>Gottsman also advised asking about next steps and about a timeframe for results. Then, follow up once every week so the problem doesn\u2019t get overlooked.<\/p>\n<p><strong>What if I know the neighbor who\u2019s smoking? Can\u2019t I just work it out with them?<\/strong><\/p>\n<p>The short answer? Yes. But Gottsman recommended approaching the situation prepared to build an ally, not an opponent. Suggest collaborating to find a solution that works for both of you.<\/p>\n<p><strong>What shouldn\u2019t I say to them?<\/strong><\/p>\n<p>If you approach your neighbors and place all blame on them rather than the factors neither of you can control (like poor ventilation), you might offend them, according to Gottsman. Tempted to tell them how they\u2019re harming their health by smoking? Don\u2019t go there, she said. Stick to the problem: the smoke coming in your apartment.<\/p>\n<p><strong>This seems like a lot of work. Can I just get a new place?<\/strong><\/p>\n<p>Generally, you can only break a lease over landlord misconduct \u2013 but management can voluntarily let you out of your lease, said Laurie Mikva, clinical assistant professor of law at Northwestern University. Work out an agreement (in writing!) with your landlord. It\u2019s better than breaking the lease and potentially going to court for unpaid rent, according to Mikva.<\/p>\n<p><strong>Looks like I\u2019m stuck here for the time being. What else I can try?<\/strong><\/p>\n<p>Gottsman suggested making your stay more comfortable. For example, you can buy certain <a href=\"https:\/\/www.hgtv.com\/design\/remodel\/interior-remodel\/10-best-plants-for-cleaning-indoor-air-pictures\">plants<\/a> that help keep indoor air clean. If you\u2019re interested in purchasing an air purifier, check out <a href=\"https:\/\/www.nytimes.com\/wirecutter\/reviews\/best-air-purifier\/\">these recommendations<\/a> from The New York Times.<\/p>\n<p>Bottom line: You have options. But there might not be a quick fix for the fumes. \u201cKnow that you probably have a journey ahead of you,\u201d Gottsman said.<\/p>\n<p><i>Erin Warwood is a reporter at Medill.
